Higgsfield sends Comfy a cease and desist; the challenge stays up
On the eve of the deadline, Higgsfield's lawyers asked Comfy to drop the Higgsfield name from its open-rebuild challenge. Comfy's CEO posted the letter and said no. Here's what each side says and what it means if you entered.
What happened. Comfy CEO Yoland Yan posted on Oct 29 that Higgsfield had sent Comfy a cease and desist the night before, and attached the three-page letter; Comfy's official account reposted it. The letter, dated Oct 28 and signed by Higgsfield's Associate General Counsel, says Comfy's use of the HIGGSFIELD trademark in the #OpenSourceHiggsfield challenge, its hashtag and URL, and the appearance of Higgsfield CEO Alex Mashrabov in the campaign video, suggest Higgsfield is connected to the event. It cites trademark infringement and false association under the US Lanham Act and unfair competition.
What Higgsfield is asking for, per the letter. Stop using the Higgsfield name for the competition, including announcing winners or showcasing entries under it; take down the campaign video and stop using Mashrabov's likeness; preserve related documents; and confirm in writing within two days. The letter also says Higgsfield doesn't object to open source, to competition, or to accurately naming Higgsfield when comparing products.
Comfy's answer. Yan wrote that the challenge is clearly labelled as organised by ComfyUI and not affiliated with or endorsed by Higgsfield, that its point is to deliver the open release he says Higgsfield promised and never shipped, and that "the challenge stays up." In a follow-up he posted titles from Higgsfield's own showcase that riff on famous films and shows, calling it ironic. As of 4 PM MDT we found no public reply from Higgsfield; its feed was running a promotion.
What it means for builders. Nothing in the letter targets entrants or their code. It's aimed at Comfy's use of the name and the video. Your workflows, repos and licences are unaffected, and the deadline is still Friday, Oct 30 at 10 AM MDT, per the challenge page. The open question is how winners get announced if the name becomes the sticking point. If you publish your own entry, describing it as an open alternative and naming Higgsfield only for comparison, as the letter itself allows, is the low-risk way to do it. This isn't legal advice.
Our take: the dispute is about branding, not about whether open rebuilds are allowed, and the most useful outcome of the challenge (studios like OpenField and Kitty Open Studio that run on open weights) is already public. We'll update this post if Higgsfield responds or the winners announcement changes.
